Terms of Service

These terms govern your use of Promotah. By creating an account, promoting an event, listing an event, or buying a ticket, you agree to them.

1. What Promotah is

Promotah is a marketplace. Event organizers list events; promoters share tracked links to those events; buyers purchase tickets. When a sale is attributed to a promoter's link, that promoter earns a commission.

Promotah is not the event producer. The organizer is responsible for the event itself — whether it happens, where, when, and what a ticket admits you to.

2. Your account

• You must be at least 18 years old to earn commission or receive payouts.
• One account per person. Handles are unique and some are reserved.
• You are responsible for activity under your account. Tell us promptly at support@promotah.com if you believe it has been compromised.
• We may suspend or close an account that violates these terms.

3. Promoters

You are an independent participant, not an employee, contractor, partner, or agent of Promotah. You choose what to promote, where, and how often. Nothing here creates an employment relationship, and you are not paid for time — only for attributed sales.

How you get paid. Every event shows the exact amount you earn per ticket before you take a link. A sale is attributed to you if the buyer arrives through your link or code and completes the purchase within the attribution window (currently 30 days, last-click).

When you get paid. Commissions are held in escrow until the event has taken place and its refund window has closed. They then become available to withdraw to the bank account you connect through Stripe. If a buyer refunds or disputes a purchase before the commission is paid out, that commission is reversed.

What you may not do.

• Buy tickets through your own link to generate commission, or arrange for others to do so on your behalf.
• Use bots, click farms, automated traffic, or repeated self-clicks to inflate activity.
• Misrepresent an event — its lineup, timing, venue, pricing, or what a ticket includes.
• Claim to represent Promotah, the organizer, or any artist.
• Spam, buy ads on a rightsholder's trademark, or promote in any way that breaks another platform's rules.
• Resell tickets above face value where prohibited by law.

We run automated checks for patterns consistent with abuse. If activity on your account is flagged, affected commissions are paused while a person reviews them, and you will see them marked as under review on your earnings page. If the review clears, they return to escrow and pay out normally. If abuse is confirmed, we may withhold the commissions involved and close the account.

4. Organizers

• You warrant that you have the right to sell tickets to the events you list.
• You are responsible for delivering the event and for honouring valid tickets.
• You set your pricing and your commission or net rate. Once a sale is made, the terms that applied at purchase time are fixed and cannot be revised downward.
• You are responsible for refunds to your buyers, and for any taxes and licences your event requires.
• You must not list an event you cannot deliver.

5. Buyers

Your contract for the event itself is with the organizer. Refunds are governed by the organizer's policy and the refund window shown at checkout. If an event is cancelled, you are entitled to a refund of the ticket price.

Tickets are delivered by email with a QR code. Do not share that code — anyone holding it can use the ticket, and each code admits once.

6. Fees and taxes

Promotah retains a portion of each transaction. Payment processing is handled by Stripe and is subject to Stripe's own terms.

You are responsible for your own taxes on anything you earn. If you are a US person and earn above the reporting threshold in a calendar year, a tax form may be issued to you and filed with the IRS.

7. Content you post

You keep ownership of what you post. You grant us a licence to display it in connection with the service. We may remove content that is unlawful, deceptive, infringing, or that misrepresents an event or artist.

8. Availability and liability

The service is provided as is. We do not guarantee uninterrupted availability, that any event will take place, or that you will earn any particular amount.

To the fullest extent permitted by law, our total liability to you for any claim relating to the service is limited to the greater of the fees we retained on your transactions in the twelve months before the claim, or one hundred dollars. We are not liable for indirect or consequential losses, including lost earnings or lost opportunity.

Nothing here limits liability that cannot be limited by law, including for fraud.

9. Changes and termination

We may update these terms. Material changes will be posted here with a new date, and continuing to use the service after that means you accept them. You may close your account at any time; commissions already earned and cleared will still be paid.
